Agreement.

1.General conditions

Условия сервиса — это Соглашение, которое определяют положения и условия использования Сервиса СonnectHome, в том числе при использовании Веб-сайта по адресу https:/remote.c-home.ua и дополнительные услуги, доступные на Веб-сайте.

The Terms of Service define the rights and obligations of users, as well as the rights, duties and responsibilities of ConnectHome as a service provider.

Предоставление услуг осуществляется в соответствии с Законом Украины «Об авторском праве и смежных правах» и другими законодательным актам Украины и не может ему противоречить.

The privacy policy is posted on the website, each potential user Websitecan familiarize themselves with it online.

Each potential User of the Website, during registration, is obliged to agree to these Terms and Conditions and the Privacy Policy, which is a mandatory action to use the service.

2. Definition.

Terms used in this agreement:

• User - an individual who has civil legal capacity and legal capacity within the meaning of the current legislation of Ukraine, a legal entity or an organization without a legal entity that is a user of the ConnectHome system;

• Аккаунт/Учётная запись — набор сведений, которые пользователь оставляет на Веб-сайте по адресу https:/remote.c-home.ua;

• Серийный номер контроллера — уникальный идентификатор контроллера, который нанесен на корпус контроллера и доступен на Web интерфейсе контроллера;

• Login is a unique set of letters and/or numbers required to access the ConnectHome service;

• Пароль — ряд знаков, защищающих от несанкционированного доступа к Веб-сайту;

• Идентификация — процесс идентификации Пользователя на основе Логина, Электронной почты и Пароля;

• Веб-сайт — интернет-страница, доступная в https:/remote.c-home.ua;

• Контроллер — управляющее устройство, соединяющее все элементы системы ConnectHome друг с другом и связывающее её с внешним миром;

• Система ConnectHome — контроллер Butler или другой контроллер ConnectHome, устройства ConnectHome, устройства других систем, которые поддерживаются контроллером ConnectHome. Полный перечень устройств компании ConnectHome можно найти find on the website;

• Сервис Удаленного доступа ConnectHome — набор программных и аппаратных инструментов, позволяющий контролировать статус и управлять устройствами домашней автоматизации, используя мобильное приложение, веб-сайт, локальный веб-интерфейс или программные приложения других систем для связи с контроллером ConnectHome, который в свою очередь связывается с остальными элементами системы через радиоканал. Сервис также позволяет управлять и контролировать статус устройств, которые являются продуктами других компаний, но соединены с системой ConnectHome, используя программные расширения либо радиоканал. Кроме того, сервис позволяет приложениям других систем, например Google Assistant, управлять устройствами системы ConnectHome, используя специальные программные расширения. The terms and conditions regarding the copyright of applications/systems integrated into the ConnectHome system are governed by agreements with the manufacturers of these systems. ConnectHome is not responsible for for devices/services of other manufacturers;

• Регистрация — процесс настройки Аккаунта, который приводит к заключению электронного соглашения между пользователем и компанией ConnectHome.

• Действия (Action) для Google Асистента — специально разработанное компанией ConnectHome приложение, которое позволяет пользователям управлять устройствами системы ConnectHome при помощи голосового Асистента от компании Google.

3. Registration.

Registration on the Website is voluntary and free of charge. To register and set up an account, please fill out the form Web — странице. Before filling out the form, the User is obliged to read and accept the Privacy Policy, posted on Website and the Terms of Service described in this agreement. By clicking on the appropriate checkboxes during the registration process, the user accepts these documents . During the registration process, you need to fill in the following fields:

• User name;

• Login;

• Password;

• The user's email address.

Upon completion of the registration form, the Service Provider creates a User Account and automatically sends a registration confirmation email to the User's email address entered during the Registration. By clicking on the link attached to this email, the User will be considered registered.

4. Technical conditions for the provision of the Services.

To use the ConnectHome services, the User must have:

• Internet access;

• Butler controller;

• a properly configured web browser;

• an active and correctly configured mailbox.

The use of the ConnectHome service is subject to typical threats associated with data transmission on the Internet. The Service Provider applies modern methods of protection and encryption of transmitted information to guarantee the User's safe use of the ConnectHome service, especially in preventing third parties from accessing the service and all confidential information. The User is responsible for the security of digital content within the limits of measures that can only be taken by the User, such as the use of anti-virus software, the use of unique passwords with a high degree of reliability, taking measures to guarantee the confidentiality of these passwords. In this regard, the User is solely responsible for the consequences of the possible absence of the above security measures, including the protection of personal data and other information, the protection of which is required by law.

5. ConnectHome system.

Система ConnectHome — это система домашней автоматизации, которая позволяет управлять бытовыми устройствами в вашем доме благодаря компактным микромодулям использующих беспроводной протокол связи Z-Wave.

The system allows you to control and manage:

• Lighting devices;

• Motors for window and gate automation (curtains, roller shutters, gates, barriers, etc.);

• Climate control devices, such as air conditioners, heating radiators, underfloor heating circuits, boilers, etc;

• Multimedia settings;

• Any other electrical appliances, such as a kettle, coffee machine, etc;

• All kinds of sensors can be connected to the system to monitor temperature, humidity, light, motion, water leaks, etc.

The system consists of a central controller and devices connected to it. A complete list of ConnectHome devices can be found on the website.

Thanks to the ConnectHome system, all connected devices can be controlled not only with the switches and remote controls that come with the device, but also with the help of the app:

1. The proprietary application ConnectHome;

2. Google's voice assistant.

6. Payments and fees in favor of third parties.

The use of the ConnectHome services may result in additional costs in connection with the use of the Internet in favor of third parties, such as mobile operators, Internet providers or others. The Service Provider is not responsible for any third-party fees and charges to third parties resulting from the use of ConnectHome services.

7. Rights and obligations of the User.

The User is obliged to use the ConnectHome services in accordance with these Terms of Service and the current legislation of Ukraine.

The use of the Services is subject to additional restrictions, according to which the User warrants and agrees not to use the ConnectHome system for other than its intended purpose, and confirms that he/she will not interact with it in any way that may be harmful:

• violates the intellectual property rights and/or any other rights of any person (including ConnectHome.)

• violates any law or regulation;

• is harmful, fraudulent, deceptive, threatening, abusive, defamatory, obscene, or otherwise unacceptable;

• jeopardizes the security of their own or someone else's Account in the ConnectHome system (for example, if the user allows someone else to log in on their behalf);

• in any way permits the receipt of a password, account information or any other security information from any user;

• violates the security of any computer network, and/or breaks any passwords and/or security encryption codes;

• decompiled, reverse engineered the Software and Products, or otherwise attempted to obtain the source code of the Software.

The user has the right to:

• be informed of any changes to these Terms and the Privacy Policy;

• uninterrupted access to the ConnectHome Services, except as provided for in clause 7 of these Terms;

• to correct the data entered in your Account;

• to delete data from your Account and terminate this Agreement.

8. Rights and obligations of the Service Provider

The Service Provider undertakes to make any reasonable and commercially reasonable efforts to guarantee the availability of the Services 24 hours a day, 7 days a week, except as follows:

• planned technical breaks in the provision of the ConnectHome Service lasting less than 15 minutes, no more than once every 24 hours (the Service Provider will try to notify about the planned breaks in the Service at least 24 hours in advance by posting a corresponding notice on the Website);

• planned technical breaks in the provision of the ConnectHome Service lasting more than 15 minutes (the Service Provider will try to notify about the planned breaks in the Service at least 48 hours in advance by posting a corresponding notice on the Website);

• Unplanned interruptions in the provision of the ConnectHome Service due to force majeure and/or force majeure circumstances are extraordinary circumstances beyond the control of ConnectHome that result in the Service Provider's inability to fulfill its obligations in whole or in part;

• failure of the Service Provider's access to the Internet;

• hacker attacks;

• failure or termination of the provision of services to the Service Provider by third parties that are necessary for the provision of the ConnectHome Service.

ConnectHome directs all its efforts to create a quality product. In this regard, the Supplier may provide updates, upgrades, patches, bug fixes and other modifications to improve the Service and related services without the User's consent and without any additional notice.

9. The term of the agreement.

This Agreement shall become effective upon your first use of the ConnectHome Services or Products and shall continue until terminated. You may terminate it at any time by sending a written notice to ConnectHome's email address office@connectHome.com.ua. It will also be immediately terminated if you fail to comply with any term of this Agreement. Upon termination of the Agreement, it shall immediately become void and you agree to cease all access to use of the ConnectHome Products, Software and Documentation. Upon termination of the Agreement, the Service Provider shall delete the User's Account and all personal data from the system WITHOUT ANY OPPORTUNITY TO RETURN THEM IN THE FUTURE.

10. Limitation of liability of the service provider.

USE OF THE WEBSITE AND SERVICES IS AT YOUR OWN RISK. The USER SHALL BE SOLELY RESPONSIBLE (AND CONNECTHOME DISCLAIMS ANY LIABILITY) FOR ANY LOSS, LIABILITY OR DAMAGES ARISING OUT OF THE USE OF THE WEBSITE AND SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES, LIABILITY OR DAMAGES CAUSED TO THE USER PERSONALLY, HIS/HER PROPERTY, PERSONAL PROPERTY, EQUIPMENT OR PERIPHERALS, CONNECTED TO THE DEVICE, COMPUTER OR MOBILE DEVICE), DATA, HOUSE, APARTMENT, BUILDING, HOUSE, BUILDING OR RESIDENCE.

The Service Provider shall not be liable for any defects and/or malfunctions in the operation of the website and services.

The Service Provider is not responsible for:

• any damage related to the conclusion, non-conclusion, performance, non-performance, improper performance, completion and/or termination of this Agreement, caused directly to the user and/or a third party to whom the user is liable;

• any damage caused by the use or incorrect operation of the website or services;

• any damage caused by malfunctions, interruptions or termination of the website or services;

• any damage caused by lost profits;

• any damages caused to the user by loss of data, breakdown, failure or destruction of equipment;

• any damage related to the possible infringement of intellectual property rights of third parties by the use of the website and services, including any damage related to claims of third parties against the user due to infringement of intellectual property rights.

11. Warranties.

The Service Provider does not warrant the operation of the website and services. It also does not guarantee that the user will be able to obtain any benefit from using the website and services.

12. Personal data, their processing and protection.

The Service Provider collects and processes the User's personal data to the extent necessary to provide the services. The Service Provider processes the User's personal data, among other things, to ensure the high quality of the services provided, to notify the User in a timely manner of any changes to these Terms of Use and/or the Privacy Policy, as well as to comply with legal obligations of the Service Provider. 13. Procedure for handling complaints and comments

Users can send their complaints and comments related to the operation of the website and services to the following e-mail address: office@connecthome.com.ua

Complaints and comments will be reviewed by the Service Provider within 14 (fourteen) business days from the date of their receipt.

A response to the user will be sent to the email address provided by the user when registering on the website.

14. Procedure for termination of the agreement

The User has the right to terminate this agreement.

The User may, without giving any reason, send a notice of termination of the Agreement to the e-mail address office@connecthome.com.ua

In the event of termination of the Agreement, the Service Provider shall immediately delete the User's account and personal data from the system without the possibility of their recovery.

15. Final provisions

These Terms of Use and the Privacy Policy are governed by the laws of Ukraine, including the Law of Ukraine "On Personal Data Protection".

By accepting these Terms and Conditions and the Privacy Policy, a non-Ukrainian user understands and agrees that products and services are provided by ConnectHome in accordance with the current legislation of Ukraine, which may not provide the same level of protection as in the user's country.

All disputes and disagreements arising out of and/or related to this agreement shall be resolved through negotiations.

The pre-trial dispute resolution procedure is mandatory. If it is impossible to resolve the dispute through negotiations, it shall be resolved in accordance with the substantive law of Ukraine, taking into account the sanity determined by the current legislation of Ukraine.

The Service Provider reserves the right to make changes to these Terms and the Privacy Policy. These changes may be made for the purpose of improvement, in case of changes in legislation in order to bring them into compliance with them, in case of changing or expanding the list of services or changing their functionality, when these changes lead to the need to amend these Terms and Conditions and the Privacy Policy to bring them in line with the needs of users.

Information about changes to the Terms of Use and/or the Privacy Policy will be sent to the no later than 14 days prior to its entry into force.

Also, information about changes and new versions of the Terms of Use and/or Privacy Policy will appear when the user logs in to the application, along with a message about the need to read and accept these terms to continue using the services. The Terms of Use and the Privacy Policy come into force on September 01, 2019.
